1. Agreement to These Terms

Jotzi is operated by Kistna Inc. By creating an account or using Jotzi, you agree to these Terms.

If you download or purchase Jotzi through Apple’s App Store, Apple’s applicable terms also apply to that download or purchase. These Terms do not replace Apple’s terms.

2. About Jotzi

Jotzi is a productivity application for capturing notes, setting reminders, remembering what matters, sharing Jotzis, and finding information you have already saved. The website at https://jotzi.ca provides public information, support, and these legal pages.

3. Eligibility and Accounts

You are responsible for the Jotzi account you use and for keeping your sign-in details secure. Use accurate account information, and contact support@jotzi.ca if you believe your account has been used without permission.

4. Your Jotzis and User Content

You retain your rights in the notes, reminders, voice recordings, and other content you create in Jotzi. Kistna Inc. does not claim ownership of your notes.

You grant Kistna Inc. a limited license to host, store, process, transmit, transcribe, display, and share that content only as needed to operate Jotzi, and only as you direct — including when you share a Jotzi or use transcription, Ask Jotzi, or Smart Memory.

You are responsible for the content you create and share. Do not use Jotzi to store or share material that is unlawful or that you do not have the right to use. Shared content becomes accessible to the people you select.

5. Reminders and Location Features

Jotzi reminders are convenience and productivity tools. Do not rely on them for emergencies, medical treatment, personal safety, or other situations where a missed or delayed prompt could cause serious harm.

Location-based reminders depend on device permissions, operating-system behavior, and location availability. A reminder may not appear if permission is off, notifications are disabled, or location is unavailable.

6. Voice and AI-Assisted Features

Voice Notes may be transcribed so they can be stored as useful text. Ask Jotzi and Smart Memory are optional productivity features. When you use them, relevant saved Jotzi content may be processed, including by OpenAI through Jotzi’s server-side systems.

Ask Jotzi works with the Jotzis you have saved. It does not search the public internet.

AI-generated responses can be inaccurate or incomplete. Verify important information yourself. These features are productivity assistance. They are not professional medical, legal, or financial advice.

7. Sharing

When you share a Jotzi, the recipient can access the shared content. Share only with people you intend to give that access. You can stop or remove sharing using the controls in the app.

8. Subscriptions

Paid features, where offered, are sold as auto-renewing subscriptions. Purchases made through a platform store are billed by that store. For the current iOS app, that store is Apple’s App Store.

The applicable price, billing period, and other purchase terms are shown in the app or App Store before you buy. Subscriptions renew automatically unless you cancel. Manage, change, or cancel a subscription through your Apple ID / App Store account settings.

Restore Purchases is available in the Jotzi app where applicable. Refunds, if any, are handled under Apple’s applicable purchase and refund rules. There is no checkout on this website, and Jotzi does not process payment cards on jotzi.ca.

9. Acceptable Use

Use Jotzi only for lawful purposes. You agree not to:

• Use Jotzi in a way that violates applicable law.
• Harass, abuse, or harm others, or violate another person’s rights.
• Interfere with or disrupt the service.
• Attempt unauthorized access to Jotzi, other accounts, or related systems.
• Use Jotzi to distribute malware or other harmful code.

10. Intellectual Property

Kistna Inc. and its licensors own Jotzi, including the application, website, software, branding, and service design. These Terms do not transfer ownership of Jotzi to you. Your content remains yours as described above.

11. Third-Party Services

Jotzi relies on third-party platforms and services to operate, including infrastructure, AI processing, and, for iOS purchases, Apple’s App Store. Their availability, performance, and terms can affect your use of Jotzi.

12. Service Availability and Changes

We may update, add, or remove features over time. We do not guarantee that Jotzi will be uninterrupted, error-free, or available at any particular time. Maintenance, network issues, device settings, and third-party outages can affect the service.

If you have a paid subscription, entitlements are provided according to the purchase you made through the applicable store. This section is not a license to ignore that purchase.

13. Account Suspension / Termination

You may stop using Jotzi at any time. We may suspend or end access if you misuse Jotzi, violate these Terms, or if we are required to do so by law or by the platform that sold a subscription.

14. Account Deletion

You can delete your Jotzi account from account controls in the app. Deletion removes your account and associated Jotzi content, subject to Recently Deleted behavior and any limited temporary retention needed for security, legal obligations, or backups.

15. Disclaimers

To the extent permitted by applicable law, Jotzi is provided “as is” and “as available.” Reminders, transcription, search, Smart Memory, and Ask Jotzi can fail or be incomplete. Do not rely on Jotzi as the sole record of critical information.

Some places do not allow certain disclaimers. If those rules apply to you, some of the language above may not apply, and you may have additional rights.

16. Limitation of Liability

To the extent permitted by applicable law, Kistna Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, arising out of your use of Jotzi.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, or for death or personal injury caused by negligence where such a limit is not allowed. Your rights may vary depending on where you live.

17. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. Nothing in these Terms limits any consumer protection rights or other rights that cannot be excluded under applicable law.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the effective date. If you continue to use Jotzi after an update, the revised Terms apply to that later use.
